The number of homes for sale rose 0.4% to 234,000 in January. At the January sales pace, it would take 9.1 months to sell that inventory, up from 8.0 months in December and the highest monthly supply since May."&nbsp;</p>
<p>Home builders have slashed their inventories to a 38 year low.&nbsp; New Homes under construction fell to a record low of 100,000 nationally.&nbsp; Builders have cut back on production of new homes, but they still face headwinds from unsold existing-homes as foreclosures continue to mount up. If a home isn&rsquo;t sold before it&rsquo;s finished, it&rsquo;s taking a record 14.2 months to sell it after completion&mdash;a reflection of the mismatch between more expensively priced homes in the inventory and lower-priced homes that have been selling.</p>
<p>The median sales price of a new home sold in January was $203,500, down 2.4% compared with a year earlier. Cheaper homes were selling better than expensive ones: 47% of sales were for less than $200,000, up from 43% in December. <p>AA COUNTY SEEKING TO IMPOSE ADDITIONAL</p>
<p>RECORDATION TAX ON SHORT SALE DEEDS</p>
</span></span><span style="font-family: Times New Roman,Times New Roman; font-size: 14pt;"><span style="font-family: Times New Roman,Times New Roman; font-size: 14pt;">
<p>As some of you may have heard, the Anne Arundel County Office of Law has recently advised the County office of Finance to impose additional recordation tax on short sale deeds based on "the amount of debt forgiven" by the mortgage lender. We strongly disagree with the reasoning upon which this directive is based and our General Counsel has been working with the Anne Arundel County Association of Realtors in an effort to reverse this position. Unfortunately, the Office of Law has now issued an updated directive which reaffirms their position. (Montgomery County also adopted this policy but then reconsidered and put it "on hold" pending further review).</p>
<p>The practical problems created for buyers, sellers, licensees, title/closing agents and lenders by this policy are significant. However, unless and until this policy is reversed all of us need to plan for the possibility that this additional tax will be imposed on the amount of debt "forgiven" by the short sale mortgage lender. Presumably, the Clerk will compute this tax by comparing the total amount due on the existing mortgage (per payoff statement issued by the lender) with the amount actually paid to the short sale lender at the time of sale to determine the amount "forgiven" and impose the recordation tax ($7.00 per $1000 in AA County) on the difference between those two amounts. Unfortunately, the precise details on how this will be determined and implemented have not yet been finalized.</p>
<p>The Maryland Association of Realtors has been made aware of this and is also working to ascertain what steps can be taken to eliminate the imposition of this additional tax. We will keep you advised as more information becomes available.</p>
